A 50% non refundable deposit is required to secure your reservation with us. Until the deposit is paid we retain the right to allocate the space to another student. The remainder of the fee is due 4 weeks before the start of your course, holiday or charter. Course fees must be paid in full prior to commences the course.
Your Yacht fully is equipped to RYA standards and is fully insured against accident and third party liability up to 3 million sterling.
We highly recommend that all clients are insured against the usual risks of travel and sailing/motor cruising holidays including personal accident, injury, loss of charter, training holiday and cancellation including flights if applicable.
All cancellations must be received in writing prior to your departure date. If a course cannot be rescheduled the same season a cancellation charge of 25% will be made for cancellations received up to 8 weeks prior to ‘Start Date’.If the cancellation is made less than 8 weeks before ‘start date’ the deposit may be transferred to another course. If the cancellation is made less than 4 weeks to the start of the course cancellation fee will be equal to the ‘Total Fee’. In the event of a course, holiday or charter being cancelled by Solaris Sailing School due to circumstances beyond our control our liability will be limited to the return of all fees already paid, not including travel expenses.
Damage or Loss of Equipment
All damages and losses attributed to carelessness will be paid for by the client at replacement cost.
In addition to the above the following are applicable to skippered charter. A security deposit of €2000 euros is payable before commencement of a charter. The insurance excess in case of damage will be deducted from the security deposit. Any losses or unauthorised expenses will also be charged against the security deposit. The security deposit or balance thereof will be returned within 14 working days of the safe return of the yacht. The security deposit will normally be taken by VISA or MASTERCARD.
A signed medical declaration must be completed at the time of booking. Candidates are advised to seek medical advice if they are in any doubt of their ability to participate in a course. Solaris Sailing School accepts no responsibility for the decision of the physical fitness of the customer to participate in a course. Students must ensure that any personal medication is brought to the course.
No liability is accepted for students whilst in, or on, any of Solaris Sailing Schools Training property or whilst embarking or disembarking any vessel used by Solaris Sailing School. All students take part in any course at their own risk. The act of signing for a training course implies that the student has understood and accepted the terms and conditions Solaris Sailing School including the risk disclaimer above and liability as explained in this document.
Solaris Sailing School shall not be liable for any expenses incurred due to Force Majeure, including Act of God, weather conditions, strikes, and acts of Government, war or any other occurrence beyond our control.
Solaris Sailing School shall not be liable for any accidents that occur whilst a student is under the influence of alcohol. The consumption of alcohol is not permitted whilst underway. If a student arrives for a training course and is considered to be under the influence of alcohol, they will be asked to leave the course and no monies refunded.
Smoking is not permitted in any interior space on board any training vessel. Please respect the school rule that no cigarette butts be thrown into the sea.
Recreational drugs of any kind are strictly forbidden by Solaris Sailing School. If found, or suspected, the customer will immediately leave the course and no monies will be refunded, nor any additional travel expenses reimbursed.
If irresponsible or negligent behaviour of a student leads to damage or loss of any item belonging or used by Solaris Sailing School, the student is responsible for replacement or repair. Damages and breakages, howsoever caused, must immediately be notified to the skipper/instructor.
The instructor/examiner’s decision is final. All students will accept all orders and decisions given by the instructor/examiner whilst onboard, or onshore, during any training provided by Solaris Sailing School. The instructor/examiner’s authority is total, day and night, in accordance with Maritime Law. If for any reason a student does not accept an order from the instructor/examiner, or a designated substitute, the student shall be considered to be in breach of our terms and conditions. If the student is placed ashore at the nearest port, no liability whatsoever shall attach itself to Solaris Sailing School and neither shall the student have any redress for any expenses, nor any redress against the instructor/examiner as a result of any action or decision by the instructor/examiner.
Mooring fees away from the vessel’s home berth are a shared responsibility of the crew and are to be paid locally. Your instructor will provide a suggested plan of harbours and inform the crew of expected costs. Mooring fees at base are included.
Certificates will only be issued at the end of a course if, in the opinion of the instructor/examiner, the student has reached the standard required. The decision is final and to be accepted by all students. Where possible Solaris Sailing School will present certificates at the end of the course. Students must remember to bring two passport photos for this purpose.
Some certificates are issued in the UK by an external authority; please allow time for receipt, processing and return delivery. The school provides a mail/courier forwarding service and will advise the relevant cost to the student. Solaris Sailing School will not be held responsible for any delays in receipt, nor any loss if delivery has been requested to an address other than that of the school. Lost certificates will incur a reissue charge to cover costs of replacement, administration and postage.
Photographs for Promotional Purposes:
You agree that any photographs taken during your time on Lady Jomo, that may feature you, can be used for Lady Jomo promotional purposes. We will endeavour to seek your approval before using.
Any dispute should be brought to the attention of the skipper/ principal at the earliest opportunity to be resolved. In the event of a dispute not being settled by mutual agreement, it is agreed that this agreement (contract) shall be governed by the laws of Spain and the parties submit to the non-exclusive jurisdiction of the courts of Palma de Mallorca. It is further agreed that all agreements between customers, clients and students and staff of Solaris Sailing School shall be governed by Spanish Law, even when the dispute occurs outside Spanish territorial waters.
Royal Yachting Association:
Solaris Sailing School is a recognised training centre of the Royal Yachting Association and is subject to regular inspections to ensure quality of training. If you have any issues with the training provided by Deep Blue Sea Training we ask that you first inform the school principal.
